Terms and Conditions
Effective from March 1, 2024
§ 1 GENERAL PROVISIONS
- This online store is operated by the Seller, i.e., YOLO LOOK limited liability company based in Częstochowa, ul. Cmentarna 6.
- Before placing an order, please read these Terms and Conditions carefully. By making a purchase in the Online Store, the Customer accepts the provisions contained in these Terms and Conditions.
§ 2 DEFINITIONS:
- Online Store – an IT system operated on this website for the sale of goods;
- Seller – YOLO LOOK limited liability company based in Częstochowa, ul. Cmentarna 6, registered in the Register of Entrepreneurs of the National Court Register under the number KRS 0001108350, NIP 5732867511, REGON 36518245500000;
- Customer – a natural person who is at least 13 years old, provided that if the person has not reached the age of 18, the consent of their legal representative is required unless they have full legal capacity. It also refers to a legal person or an organizational unit without legal personality, which has been granted legal capacity under applicable laws and uses the Online Store, in particular, places an order under the terms specified in these Terms and Conditions;
- Account – a collection of information designated by an individual name (login) and password provided by the Customer in the IT system of the Online Store, where the data provided by the Customer during registration is stored, along with information on their orders;
- Consumer – a Customer who is a natural person making a legal transaction not directly related to their business or professional activity, whose rights are defined by the Consumer Rights Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended);
- Order Processing Time – the number of business days required to complete an order placed by the Customer, after which the ordered goods will be handed over to the carrier for delivery to the address specified by the Customer in the order;
- Newsletter – an electronic distribution service provided via email, enabling Customers to receive periodic content from the Seller containing information about Products and the operation of the Online Store.
- Business Days – days from Monday to Friday, excluding public holidays.
- Order – a declaration of intent by the Customer, submitted via the Online Store, specifying the type and quantity of goods, payment method, delivery method, place of delivery, and Customer details, constituting an offer to conclude a sales contract for the goods ordered through the Online Store.
- Payment – a monetary consideration made by the Customer for purchases in the Online Store.
§ 3 ABOUT THE ONLINE STORE
- The Online Store sells clothing online.
- The clothing offered in the Online Store is original and designed by Polish fashion designers, fully manufactured in Poland.
- The clothing manufacturer is the Seller. No product or clothing element is produced outside of Poland, particularly in Eastern countries.
- Each Product is accompanied by a description that includes photographs, name, price, size, and features.
- All products offered on this website are new, free from physical and legal defects.

§ 4 CUSTOMER OBLIGATIONS
The Customer using the Online Store is required to:
- Use the Online Store in accordance with applicable laws and these Terms and Conditions, respecting good customs and the personal rights of others;
- Not provide or transmit any unlawful content;
- Use the Online Store in a manner that does not disrupt its functionality;
- Use all content posted on the Online Store solely for personal use;
- Not engage in actions such as sending or posting unsolicited information (spam);
- Collect purchased goods from the carrier within 3 days of the first delivery attempt, especially for cash-on-delivery shipments. Failure to collect goods will result in the Customer being charged for both delivery and return shipping costs.
§ 5 REGISTRATION AND LOGIN
- Registering a Customer Account in the Online Store is voluntary and free of charge.
- Browsing the store’s offer, placing orders, and obtaining information is possible without registration.
- Some functionalities, additional services, promotional offers, or other preferences may require registration.
- Registering an account is possible by selecting the login option on the main page of the Online Store.
- To register a Customer Account, the Customer must complete the registration form, accept these Terms and Conditions, and consent to the processing of their personal data.
- After registration, the Customer has the right to view and edit their data at any time. The Customer can delete their account, but the Online Store reserves the right to retain certain data necessary for handling returns or complaints.
- The Online Store may block an account for a fixed or indefinite period due to a violation of § 4 of these Terms and Conditions.
- The Online Store is not responsible for the consequences resulting from providing false data during registration or order placement.
§ 6 PLACING ORDERS
- Orders can be placed through the Online Store’s website, either with a registered account or without it.
- The availability of goods, delivery terms, prices, and discounts may vary depending on whether the order is placed with an account or without it.
- To place an order without registering an account, the Customer must provide personal data necessary for contract execution, such as name, address, phone number, and email.
- The Customer places an order using the “Cart” functionality. Selecting “Add to Cart” adds a product to the cart.
- Clicking “BUY NOW” constitutes an offer to purchase the selected goods and an obligation to pay.
- The order summary is automatically sent to the Customer’s email address.
§ 7 PRODUCT PRICES
- The prices of products in the Online Store are indicated for each offered product. Prices may be displayed in different currencies depending on the customer’s preference and the functionalities of the online store.
- Product prices are given as gross amounts. They do not include delivery costs. Information about delivery costs is provided during the order process, must be accepted by the Customer, and is included in the total amount to be paid.
- The provisions of the previous point do not preclude the Online Store from granting a discount equal to the delivery costs. Such a discount may be temporary (a promotional action), targeted at a specific group of customers, a group of customers from a particular region, or based on any other criterion determined by the Online Store.
§ 8 PAYMENTS
- The Online Store accepts the following payment methods for orders:
- Instant online transfer (PayU),
- Credit card payment,
- Traditional bank transfer,
- Cash on delivery.
- During the order process, the Customer can choose the payment method for the ordered product. Each time, before placing an offer to conclude a sales contract, the Customer will have the option to select a payment method from the available options.
- If the Customer chooses online transfer, credit card, or traditional bank transfer as the payment method, failure to make the payment within 7 days will result in the automatic cancellation of the order.
- If the Customer selects the “Cash on Delivery” payment method, payment must be made to the courier upon receipt of the shipment.
- For each order, the Online Store reserves the right to exclude certain payment methods (especially cash on delivery for international shipments).
- The Online Store accepts only payments made from bank accounts within the European Union (EU).
- All transaction costs are borne by the Customer.
- The ownership of the product is transferred to the Customer only after payment is made.
§ 9 DELIVERY METHODS
- The store delivers ordered products via a courier service or parcel lockers to the address provided by the Customer.
- The cost of delivery may vary depending on the chosen delivery method.
- For deliveries outside Poland, shipments are made via a courier service, and the delivery costs are based on the courier company’s pricing, which is covered by the buyer. The shipping costs outside Poland depend on the destination and the weight of the package. To determine the shipping costs outside Poland, the Customer should contact the store at: biuro@yololook.com.
- If, before receiving the shipment, it is found that it has been damaged or has missing content, the Customer should immediately request the carrier to prepare a protocol determining the condition of the shipment and the circumstances of the damage. If damage or loss is discovered after delivery, the Customer should report the issue to the carrier as soon as possible, but no later than within 7 days of receiving the shipment.
§ 10 ORDER PROCESSING TIME
- The order processing time for orders placed in the Online Store will not exceed 4 business days. For products marked as “made to order,” the processing time will not exceed 10 business days. A shorter processing time indicated on the store’s website means the most probable order processing time but may, in exceptional cases, be extended up to the time specified in this paragraph.
- The order processing time begins when the order is placed in the Online Store and lasts until the product is handed over to the courier for delivery. For products marked as “made to order,” the processing time starts from the moment the payment is received.
- Products ordered in the Online Store are delivered with a proof of purchase. Upon request, the Seller issues VAT invoices.
- The transfer of ownership and the right to dispose of the goods as the owner occurs when the goods are handed over to the carrier.
- If delivery is delayed, the Customer may set an additional deadline for the Seller, and if it is not met, the Customer has the right to withdraw from the contract.
- The place of contract conclusion is the Seller’s registered office.
§ 11 RIGHT OF WITHDRAWAL
- According to Article 27 of the Consumer Rights Act of May 30, 2014 (Journal of Laws of 2014, item 827), a Customer who is a Consumer and has entered into a distance contract via the Online Store may withdraw from the contract within 14 days without giving any reason.
- The withdrawal period begins on the day the Consumer takes possession of the goods or when a third party indicated by the Consumer (other than the carrier) takes possession of the goods.
- The Consumer may withdraw from the contract by informing the Seller of their decision to withdraw through an unequivocal statement sent by post to the Seller’s correspondence address specified in these Terms and Conditions (§ 3, point 6).
- To meet the withdrawal deadline, it is sufficient to send the statement before the withdrawal period expires.
- In the event of withdrawal, the Consumer must return the goods immediately, but no later than within 14 days from the day they took possession of the goods. To meet the deadline, it is sufficient to send the goods before the end of the 14-day period to the Seller’s correspondence address specified in these Terms and Conditions (§ 3, point 6).
- The Consumer must bear the direct cost of returning the goods.
- The Seller provides Customers with an option for quick returns via InPost’s quick returns service at www.szybkiezwroty.pl. However, using this service and submitting a return request through www.szybkiezwroty.pl does not constitute a formal withdrawal statement.
- To ensure compliance with the statutory withdrawal period (14 days), the returned product must be shipped within that timeframe using the above service or another carrier, along with the return form available at: https://yololook.com/wymiany-zwroty-reklamacje/. Returns without the attached form will not be processed.
- The Consumer is responsible for any reduction in the value of the goods resulting from their use in a way that goes beyond what is necessary to establish their nature, characteristics, and functioning (Article 34, paragraph 4 of the Consumer Rights Act of May 30, 2014).
§ 12 COMPLAINTS
- The Seller is obliged to deliver goods to Customers without physical or legal defects and is liable for defects under the provisions of the Civil Code of April 23, 1964 (consolidated text: Journal of Laws of 2014, item 121, as amended), particularly Articles 556 and subsequent.
- A complaint may be submitted by the Customer by filling out the complaint form available on the Online Store website and sending the product to the store’s address.
- To exercise the rights under warranty, the Customer must notify the Online Store by using the form available on the website (complaint form) or by sending an email to: biuro@yololook.com.
- To facilitate and speed up complaint processing, it is recommended that the Customer provide details, including the type and date of the issue, the Customer’s request, and their contact details.
- If necessary for the Seller to respond to a complaint or fulfill warranty obligations, the Customer will be asked to return the goods to the Seller at the Seller’s expense to the address: Cmentarna 6, 42-200 Częstochowa. Before returning the product, and after submitting a complaint, the store may ask the Customer to provide photos of the product being complained about.
- The complaint will be reviewed within 14 days from the date of receipt of a complete complaint submission. If there are any missing details in the complaint submission, the store will notify the Customer immediately, along with instructions on how to complete the complaint submission.
- If a defect is found in the product, the Customer has the right to:
- Request removal of the defect – in this case, the store must remove the defect within a reasonable time;
- Request a replacement product free from defects – in this case, the store must replace the defective product with a new one;
- Request a price reduction or withdraw from the contract, unless the store immediately replaces the product with one free of defects or removes the defect. The reduced price should be proportional to the price under the contract.
- The costs of replacement or repair are borne by the Seller.
- The Seller is obliged to accept the defective product from the Customer if the product is replaced or the contract is withdrawn.
- If the Customer requests a replacement or repair, or submits a statement requesting a price reduction, specifying the amount of reduction, and the Store does not respond within 14 days, the request is considered justified.
- If only some of the sold items are defective and can be separated from the defect-free items without damage to either party, the Customer’s right to withdraw from the contract applies only to the defective items.
- The Customer cannot withdraw from the contract if the defect is insignificant.
- The Online Store is not liable for physical defects that occurred after the risk passed to the Customer.
- The following issues are not covered under complaints:
- Normal wear and tear of the product,
- Removable parts such as fasteners, accessories, snaps, buttons, etc.,
- Mechanical damage (scratches, tears, rips, abrasions, detachment of ornaments, zippers, etc.) caused during use,
- Damage due to improper or lack of maintenance,
- Damage caused by using the item contrary to its intended purpose,
- Comfort issues, water penetration (unless explicitly stated that the product is waterproof).
- The store is released from liability under warranty if the Customer was aware of the defect at the time of contract conclusion.
- The Seller is liable under the warranty if a physical defect is found within two years from the date the product was handed over to the Customer.
- The claim for defect removal or product replacement expires one year from the date the defect is discovered. However, in the case of a purchase by a Consumer, the limitation period cannot end before the two-year period mentioned in point 16 expires.
§ 13 COPYRIGHTS
- The rights to the content of the Online Store website, including the graphic layout, photos, trademarks, clothing designs, logos, and other content and elements, belong to the Seller.
- Copying, modifying, or otherwise using the Online Store website or its content without the Seller’s consent is prohibited.
§ 14 FINAL PROVISIONS
- The Online Store reserves the right to offer special promotions granting better purchasing conditions than those specified in these Terms and Conditions. Special promotions may apply to specific products or product groups, particular groups of customers, or any other criteria defined by the Online Store. Special offers must be clearly and explicitly defined during the Customer’s order placement. In case of doubts, these Terms and Conditions shall prevail.
- The Online Dispute Resolution (ODR) platform is available at http://ec.europa.eu/consumers/odr. The ODR platform is an interactive, multilingual website that provides a single point of access for consumers and businesses seeking to resolve disputes out of court concerning contractual obligations arising from online sales or service contracts.
- In matters not regulated by these Terms and Conditions, the provisions of the Civil Code, the Act on the Provision of Electronic Services, and other applicable Polish laws shall apply.
- These Terms and Conditions come into force on July 10, 2017, and apply to contracts concluded after that date.
